These terms and conditions govern the supply of goods by Casabu Limited and are deemed to be accepted upon first use of Casabu.com (the website). If you do not agree to be bound by these terms and conditions you should stop using the website immediately.
These terms and conditions shall apply to the sale of all goods and the provision of all services by Casabu.com and shall prevail over any other terms and conditions that may be in existence unless expressly agreed otherwise in writing.
No part of this website is intended to constitute an offer that is capable of acceptance by any party.
1. Age restrictions
Use of this website is restricted to persons over 18 years of age, or the legal age of majority in the country in which they reside or from which they are accessing this site, where this is higher.
2. Business customers
These terms and conditions do not apply to parties buying goods in the course of business.
3. International customers
Use of the website is restricted to persons residing in the United Kingdom.
4. Customer accounts
4.1 In order to purchase goods on this website you are required to create a user account by providing certain personal details and payment information. The details required from you may vary depending upon your use of the website.
4.2 By continuing to use this website you:
4.2.1 warrant that all the information provided by you during the process of creating your user account is true and accurate and agree to keep that information updated correctly at all times;
4.2.2 agree to keep your username and password confidential and secure and not to allow any other person to use your user account;
4.2.3 agree to maintain only one user account for all purchases;
4.2.4 agree to notify Casabu Limited immediately in the event that you believe that the security of your user account has been compromised in any way whatsoever;
4.2.5 warrant that you have permission to submit payment information where such permission is required.
5. Duration and Termination
5.1 This agreement shall come into force upon your first use of the website and shall remain in force indefinitely from that date, subject to the following provisions.
5.2 Either Casabu Limited or you can terminate your account at any time without giving reasons.
5.3 Casabu Limited reserves the right to cancel any purchases, without providing reasons, for any reason and at any time prior to processing payment and despatch. In the event that an order is cancelled for any reason prior to despatch but after the payment is processed you will be refunded any monies paid in relation to those purchases promptly.
5.4 The rights to terminate this agreement given in this clause shall not prejudice any other right or remedy of either party in respect of the breach concerned (if any) or any other breach.
6. Goods, pricing and availability
6.1 The placing of any order by you shall be deemed to be an offer to purchase goods subject to these terms and conditions.
6.2 Whilst every effort has been made to ensure that all representations and descriptions of goods available from Casabu Limited correspond to the actual goods, Casabu Limited is not responsible for any variations from these descriptions. This does not exclude our liability for mistakes due to negligence on our part and refers only to variations of the correct goods, not different goods altogether. Incorrect goods are covered by our refund policy.
6.3 Where appropriate you may be required to select your purchases by specifying your required features, such as the size, colour, model and quantity of the goods you are purchasing.
6.4 Casabu Limited does not represent or warrant that such goods will be available. Indications of the availability of goods for purchase may be provided on the website, however, these indications may not take into account any sales that have taken place during your visit to the website or any other factors that may affect the availability of the goods.
6.5 All efforts are made to ensure pricing information on the website is correct at the time of going online. Casabu Limited reserves the right to change prices and alter or remove any special offers from time to time as necessary.
6.6 In the event that prices are changed during the period between receiving and processing your order you will be contacted prior to the processing of your order with details of the new price.
6.7 All prices on the website include VAT. Casabu Limited’s VAT number is 126191331.
7. Delivery
7.1 Casabu Limited will deliver orders in a delivery window of 2 - 4 weeks as standard. Where any goods will be subject to different delivery estimates (for instance if they are sourced from outside the UK), the delivery details will be contained within the product description.
7.2 Whilst Casabu Limited will make every effort to ensure that delivery of all goods purchased takes place in accordance with either it’s general delivery estimates or any special delivery estimates that are applicable it makes no representation or warranty in this regard.
7.3 Where Casabu Limited become aware that there will be a delay with delivery it will contact you promptly to advise you of the new estimated delivery date.
7.4 By making a purchase in accordance with these terms and conditions you accept that any delivery date we provide to you is an estimate, that longer than average delivery times may be needed to enable us to supply the goods to you at discounted prices and that the time of delivery shall not be of the essence.
8. Returns policy
8.1 If you receive incorrect or faulty goods you should contact us within 7 days to arrange for the collection and return of the goods at our expense and to inform us whether you wish to replace the goods (subject to availability) or receive a refund through the payment method used by you when purchasing the goods. Refunds and replacements will be within 10 working days of receipt of the returned goods in their original condition and packaging.
8.2 If you change your mind about your purchase you can cancel your order at any time during the period beginning with the completion of your order and ending 7 days after the goods have been delivered. Goods can only be returned under this clause if their packaging remains unopened and they are returned to us in a resaleable condition. We will refund the purchase price of any goods returned for this reason upon receipt of the returned goods in their original condition and packaging, however, you will remain responsible for paying both the cost of delivering the goods to you and the cost of returning the goods to us.
8.3 You will be deemed to have accepted the goods if they are not returned to us in accordance with the provisions of clauses 8.1 or 8.2 above.
9. Payment and transfer of title
9.1 Payment for all goods ordered will be processed prior to the goods being dispatched to you.
9.2 We do not store credit card details nor do we share customer details with any 3rd parties
9.3 Where payment is made via Paypal or other similar service all Paypal or other third party charges are your responsibility
9.4 Title to the goods will transfer upon delivery of the goods to you subject to the terms of clause 8 above.
10. Promotional credit voucher offers
10.1 Casabu Limited may offer to apply a promotional credit to your account on the satisfaction of certain conditions which will be advertised on Casabu.com from time to time.
10.2 Casabu Limited reserves the right to withdraw any voucher offers at any time without notice and without providing a reason.
10.3 Promotional credit vouchers will have no cash value and will be redeemable only against orders made via the website with a minimum value of £30 excluding delivery charges. Credit vouchers may only be redeemed against purchases of goods and cannot be used to purchase gift vouchers or other services.
10.4 Promotional credit vouchers will only be valid when your account is operated correctly in accordance with clause 4. Casabu Limited reserves the right to refuse to issue a credit voucher or to cancel any voucher issued without providing a reason where it suspects a breach of clause 4.
10.5 Promotional credit vouchers will expire 90 days after issue unless expressly stated otherwise in writing.
10.6 Credit vouchers are not transferable.
10.7 Where your account is terminated in accordance with clause 5 any promotional credit vouchers applied to your account will be cancelled.
11. Intellectual property
11.1 All content included on Casabu.com (excluding that to which clause 11 below applies) including, but not limited to, text, graphics, logos, icons, images, sound clips, video clips, data compilations, tutorials, page layout, underlying code and software is the property of Casabu Limited.
11.2 By continuing to use Casabu.com you acknowledge that the material referred to in clause 10.1 is protected by applicable United Kingdom and International intellectual property and other laws.
11.3 No part of the content may be reproduced by any user without the express written permission of Casabu Limited.
12. Third party intellectual property and material
12.1 Unless otherwise expressly indicated all intellectual property rights including, but not limited to, copyright and trademarks in product images and descriptions are the property of the manufacturers or distributors of such products.
12.2 You may not reproduce, copy, distribute, store, or in any way re-use such material without the express written permission to do so by the relevant manufacturer or supplier.
13. Confidentiality and Privacy

13.2 Unless Casabu Limited is obliged to do so by law any information retained under this clause will not be disclosed to any other party without the express written permission of the party to whom the information relates.
13.3 The provisions of this clause shall continue in force notwithstanding the termination of this agreement for any reason.

14.1 Casabu.com may contain links to other sites. Unless expressly stated these sites are not under the control of Casabu Limited and we assume no responsibility for the content of such web sites and disclaim liability for any and all forms of loss or damage arising out of the use of them. The inclusion of a link to another site on Casabu.com does not imply any endorsement of the sites themselves or of those in control of them.
14.2 Those wishing to place a link to Casabu.com on other sites may do so only to the home page of the site without prior permission. Deep linking to specific pages within the site is not permitted without express written authorisation from Casabu Limited.

15.1 When using the enquiry form or any other form of communication via the website you agree to abide by the following rules:

17. Changes to Casabu.com and to these terms and conditions
Casabu Limited reserves the right to change the content of Casabu.com or these terms and conditions at any time. You will be bound by any changes to these terms and conditions from the first time you use Casabu.com following the changes. If Casabu Limited is required by law to make any changes to these terms and conditions these will apply immediately and automatically to any orders currently pending as well as any orders placed by you in the future.
18. Availability of the Website
18.1 Casabu Limited accepts no liability for any disruption or non-availability of the web site resulting from external causes including, but not limited to, ISP equipment failure, host equipment failure, communications network failure, power failure, natural events, acts of war or legal restrictions and censorship.
18.2 Casabu Limited gives no warranty that the website will be free of defects and/or faults. To the maximum extent permitted by the law we provide no warranties (express or implied) of fitness for a particular purpose, accuracy of information, compatibility and satisfactory quality.
19. Limitation of Liability
19.1 The liability of Casabu Limited for any direct or indirect loss or damage, foreseeable or otherwise including any indirect, consequential, special or exemplary damages arising out of our breach of these terms and conditions shall be limited to the price paid by the user for any goods or services, if any.
19.2 For all other direct or indirect loss or damage, foreseeable or otherwise including any indirect, consequential, special or exemplary damages arising from the use of Casabu.com or any information contained therein, to the maximum extent permitted by law, Casabu Limited accepts no liability to either the user or any third party.
19.3 Users should be aware that they use Casabu.com, it’s services and content at their own risk.
19.4 Nothing in these terms and conditions excludes or restricts liability for death or personal injury resulting from any negligence or fraud on the part of Casabu Limited.
20. Nature of the Agreement
20.1 No failure or delay by either party in exercising any of it’s rights under this agreement shall be deemed to be a waiver of that right, and no waiver by either party of a breach of any provision of this agreement shall be deemed to be a waiver of any subsequent breach of the same or any other provision.
20.2 If any provision of this agreement is held by any court or other competent authority to be invalid or unenforceable in whole or in part, this agreement shall continue to be valid as to it’s other provisions and the remainder of the affected provision.
20.3 All notices under these terms and conditions shall be in writing and be deemed duly given if signed by a duly authorised officer of the party giving the notice and delivered to the other party at it’s registered or principal office or to such other address as may be notified to one party by the other from time to time.
20.4 In the event of any conflict between these terms and conditions and any prior versions thereof, the provisions of these terms and conditions shall prevail unless it is expressly stated otherwise.
20.5 Casabu Limited shall be free to sub-contract the supply of goods or the provision of the services (or any part thereof) provided that it shall ensure that any and all sub-contractors are reasonably skilled in the relevant practices.
21. Force Majeure
Casabu Limited shall not be liable for any failure or delay in performing their obligations under this agreement where such failure or delay results from any cause that is beyond their reasonable control. Such causes include, but are not limited to, power failure, ISP failure, industrial action, civil unrest, fire, flood, storms, earthquakes, acts of terrorism or war and governmental action.
22. Applicable Law and Jurisdiction
These terms and conditions and the relationship between you, the user, and Casabu Limited shall be governed by and construed in accordance with the Laws of England and both parties submit to the exclusive jurisdiction of the courts of England.
23. Casabu Price Promise
23.1 We can only match identical items - including colour and size variations, in stock and available for immediate delivery/collection.
23.2 Comparison value includes delivery costs.
23.3 The competitors price must be available to all customers and excludes any VIP membership or personal discounts.
23.4 Price matching cannot be used in conjunction with any other offer or discount.
23.5 In the unlikely instance of a price being beaten, we will happily refund you the difference within 7 days of delivery of the item.
24. Competitions & Promotions
24.1 By submitting your entry, you are agreeing that your entry is an original work, belongs to you and has not been copied from others.
24.2 By entering a Casabu competition you give your consent for us to publish, distribute and display your entry throughout the site.
24.3 If you are a winner, you agree to any reasonable requests we have relating to publicity, such as reusing the submitted image on casabu.com and our social profiles.
